Where employees of one of the institutions from the ETH Domain generate data in the course of their employment, the institution in question is entitled to assert rights in that data. A different rule will apply only in the case of copyright to literary and artistic works which are represented in data. This means that the institutions can generally determine how and in what form data are to be made accessible as ORD. However, ORD are subject to certain restrictions. These may arise from applicable law, thirdparty rights or contract.
